These Terms of Service ("Terms") govern your access to and use of the website arcusforward.com (the "Site"), operated by Arcus Forge LLC ("Arcus Forge LLC", "we", "us", or "our"). ArcusForward is a division of Arcus Forge. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Informational purpose only

The Site presents information about our services. Its content is provided for general informational purposes and does not constitute professional, legal, financial, or technical advice, nor a binding offer to provide services.

2. No client relationship; engagements

Using the Site, submitting the contact form, or scheduling a call does not create a client, advisory, or contractual relationship. Any engagement is governed exclusively by a separate written Master Services Agreement and Statement of Work executed by both parties. In the event of a conflict, that executed agreement controls over the Site and these Terms.

3. Acceptable use

You agree not to: (a) use the Site unlawfully or in violation of these Terms; (b) attempt to gain unauthorized access to, disrupt, or impair the Site or its infrastructure; (c) scrape, harvest, or collect data through automated means without our consent; (d) introduce malware or conduct security testing without authorization; or (e) infringe our or any third party's intellectual property or other rights.

4. Intellectual property

The Site and its content, design, text, graphics, and the ArcusForward and Arcus Forge names and marks are owned by Arcus Forge LLC or its licensors and are protected by applicable law. You are granted a limited, revocable, non-exclusive license to access and view the Site for legitimate evaluation purposes. No other rights are granted. Ownership of deliverables created during an engagement is governed solely by the applicable engagement agreement.

5. Third-party services and links

The Site relies on or links to third-party services (for example, calendar scheduling and form processing) and may link to third-party websites. We do not control and are not responsible for their content, availability, or practices, and your use of them is subject to their terms.

6. Disclaimer of warranties

The Site is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

7. Limitation of liability

To the maximum extent permitted by law, Arcus Forge LLC and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the Site. Our aggregate liability relating to the Site will not exceed one hundred U.S. dollars (US$100).

8. Indemnification

You agree to indemnify and hold harmless Arcus Forge LLC from any claims, damages, liabilities, and expenses arising out of your misuse of the Site or violation of these Terms.

9. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in that jurisdiction for any dispute not subject to an applicable engagement agreement.

11. Changes to these Terms

We may modify these Terms at any time. The "Last updated" date reflects the latest revision, and your continued use of the Site after changes constitutes acceptance.

12. Severability and entire agreement

If any provision is found unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, constitute the entire agreement regarding your use of the Site.
